WHY DID EVAN BAYH VOTE FOR KYL-LIEBERMAN?

bayhear.jpgI understand Evan Bayh's decision to vote against the budget. In a Senate with 59 Democrats, the opportunity to emerge as the marquee swing vote is undeniably attractive. It brings with it real power over policy and real celebrity in Washington. And there's even a legitimate argument that Bayh developed in his statement today. He praises the budget for funding "important priorities like affordable health care, energy independence, job creation, and education improvements, rather than tax cuts for the most affluent," but then says that "under this budget, our national debt skyrockets from $11.1 trillion today to an estimated $17 trillion in 2014...I cannot support such results."

Fair enough. But then why vote -- on the very same day -- for the Kyl-Lincoln bill lowering the tax rate on estates over $7 million from 45 percent to 35 percent and reducing charitable giving? That's $250 billion more debt over 10 years. It's in direct conflict with Bayh's statement on the budget. It makes him look insincere.

The obvious answer is that it's important to wealthy contributors in his state. But Bayh doesn't face reelection until 2014. No one will remember -- much less contribute -- based on a vote in 2009. Nor is there a presidential run in his near future. And I simply refuse to believe that Bayh thinks it an important point of principle -- more important than debt reduction or health care -- that extremely wealthy Americans pay 35 percent, rather than 45 percent, on their estates.

Literally the only compelling justification I can come up with is self-interest: Bayh has a net worth estimated between $3 million and $14 million. That's the sort of thing that sensitizes you to the downsides of the estate tax real quick. But even that's not totally satisfying. Calls to Bayh's office went unreturned. And so I wonder.

Correction: Bayh is up in 2010, not 2014 as I mistakenly thought. It's not a particularly contested reelection. He has no serious challengers, a massive advantage in fundraising ($10,000,000 on hand, and that was in 2008, before he'd really started fundraising for reelection), full name recognition, solid approval ratings, and is running in a state that Barack Obama won. So I don't think it's plausible to argue that supporting Kyl-Lincoln is crucial to his reelection. But he might.

Farmers care about the estate tax. Indiana has them. Lots of attacks on Bayh from this blog. He's brave to go against the administration -- and he has the hair to do it.

Perhaps the reason he has solid approval ratings in this still rather conservative state is that it's difficult to portray him as a dirty socialist because he frequently casts conservative votes. Perhaps I'm overly cynical, but I think a lot of the behavior of politicians is a simple function of their perceptions as to what helps them win reelection. And let's not forget, the progressive coalition that handed the state to Obama is not likely to be as big a percentage of the electorate in a midterm year. If this turns out to be mostly just posturing, and Bayh's behavior doesn't actually impede the president's agenda, I don't see the big harm. But if his actions prevent climate or healthcare legislation from passing (or makes the eventual enacted legislation significantly inferior) then I fervently hope he faces major primary opposition for the rest of his career.

This happens every eight years, guys. Evan Bayh is John McCain. Evan Bayh is Bob Kerrey. There's ALWAYS a 'centrist' (read: Washington establishment) senator from the President's own party who chooses to act like a grandstanding tool. This happens over and over again and it is chiefy attributable to the fact that senators are placed in a political and social environment that conditions them to be awful people.

Don't worry; wait a few years and Bayh will scoot towards the centre, just like McCain did, because he wants to be President some day.

Judges must recuse themselves from cases where they have a vested interest (or often even an appearance of a conflict), and yet Bayh can vote for legislation that could directly result in a several million dollar windfall to his estate. That seems wrong to me. I'm getting into fantasy land here, but shouldn't Congress have some sort of procedure for dealing with such blatant conflicts? Perhaps letting the House delegation from the state, or another mechanism decide that Senator's vote?

Re: Indiana farmers being concerned about the estate tax. I doubt that many will be above the exemption limit, but if they are, I think that most people would be fine with exemptions for independent, working farmers (but not, of course, for the Hiltons to stash wealth in farms to avoid the tax). As predicted, Bayh will be bitch slapped by the democratic establishment and their call girls like ana marie cox and olbermann. I'm waiting to see what they have on him. Bob F. hinted at something, but I don't get it. Unless he whimpers and bends over, whatever they have on him will make it into the mainstream.

The real reason is that he's a douche.

He is damn hot. Put a picture of him beside Barney Frank, Jerry Nadler, Barbara Mikulski, Henry Waxman, and Harry Reid, and you tell me who you gonna follow? His late parents would actually be proud of him.

Evan Bayh isn't a "centrist" Democrat. He's a leftist Republican. He really needs to switch party affiliation along with Joe Lieberman.

Here's what you don't know about Bayh:

As governor of Indiana, he balanced the budget every year of his administration without raising taxes. In fact, he cut taxes during his time in the governor's mansion.

There is no conflict between cutting taxes and reducing the deficit. Bayh thinks we spend too much, not that we tax too little. There's nothing illogical or inconsistent about this view, especially when Bayh actually governed that way.

BTW, Bill Richardson and Gary Locke, two guys who Obama wanted in his administration, also balanced budget after budget while cutting taxes.

It can be done. Just because Republicans are morons about how they go about fiscal policy doesn't mean that tax cutting and spending restraint isn't a good idea. It just means that only Democrats are good at it.

Not to slag Ezra too much, but he really should look into the records of the more well-regarded Democratic governors, like Howard Dean, Phil Bresesen, Bob Graham, and of course Bayh, Locke, and Richardson. Opposing big deficits while favoring tax cuts is not hypocritical, just as favoring some spending increases while worrying about deficits isn't hypocritical. It's the results that count, and Bayh sees a lot of things in this bloated budget that he doesn't like. I agree with him. We don't need double digit increases across the board in every program. Obama pledged to go line by line and eliminate all the programs that weren't working. It would be nice if he'd do that BEFORE increasing every line item in the budget by 10%.

Parker's piece is mostly about how silly she thinks it is for liberals to organize a boycott of Whole Foods Market, since the company and its CEO are supposed to be environmental heroes and even health heroes according to Parker. But the CEO, John Mackey, is hard-line anti-union and anti-health-care reform, so opposition to him on economic grounds is far from silly. This is probably supposed to be a counter-example to birthers and town-hall brownshirts, who are insane, not silly.
